 4inall, a company incorporated under the Companies Act, 2013, with its corporate office at Shop no:1, Skandhanshi Empire Building, Beside C.N. Hospitals Birla Gate, Kurnool, Andhra Pradesh. has created an intercessor online platform by the name 4inall, https://www.4inall.com which acts as an intermediary e-commerce marketplace facilitating auto rickshaw rides. The Company does not provide any services to users other than providing mobility solutions.

The Company is not and cannot be a party to any transaction between you and the third party sellers or auto rickshaw driver, or have any control, involvement or influence over the products purchased by you or services received by you from such third-party sellers/ auto drivers. (Hereinafter together referred to a “Products and Services”).

 

By accessing and/or utilizing the website or the App the user admits that he/she has read understood and agrees to the terms and conditions. If user do not agree to obey the User Agreement (the “Agreement”), then he/she is not allowed to access or use the website or App. All the texts, designs, content, graphics, and other works are copyrighted works of the organization. The Company acknowledges patented rights of third parties displayed on the Website.

The purpose behind this Agreement the expressions "we", "us" or "our", refer to 4inall or Company user conversely. When the user utilizes the services available on the website or on the App, user agree to our collection, use, and exposure of information about them as portrayed both in this Agreement and the Privacy Policy shown on the website and in the App.

 

The information contained on or linked to this website is general information only. Nothing on this website is or purports to be advice. You should not rely on any information on or linked to this website.

 

The services that we at 4inall provide to the user is subject to the following terms and conditions:

This Agreement governs the utilization of specific material obliged on the Website and on the App, present the terms and conditions that apply to usage of the website by Users. By using the Website, the user consents to agrees to the entirety of the terms and conditions concerning this. The right to use Website is close to user and isn't transferable to some other person or entity. The user is liable for all use of the user's account (under any screen name or password) and for ensuring that all use of the user’s account agrees completely with the provision of this Agreement. The user will be liable for securing the confidentiality of the user's password(s) if any. We will have the privilege whenever to change or cease any aspect or feature of Website orApp ,content, material, and outsider correspondence connect to (in this referred to as "Third Party Websites") required for access or use.

 

Changed Terms

 The Company will have the privilege whenever to change or modify the terms and conditions relevant to the user's use of the website, or any part thereof, or to impose new conditions.

Such changes, modifications, additions or cancellations will be taking effect immediately upon notice thereof, which might be given by means including, however not limited to, posting on Website, or by electronic or conventional mail, or by some other methods by which user acquires notice thereof. Any use of the Website or App by the user after such notice will be regarded to constitute an acknowledgment by the user of such changes, modifications or additions.

 

Member Account, Password and Security

 To enjoy any of our services, the user must complete the registration process by providing us with complete and accurate information as prompted by the appropriate registration form. User also will select a password and a user name.

User is completely responsible for maintaining their confidentiality of user’s password and account. Furthermore, user will be entirely responsible for all activities that will occur under user’s account. The user consents to inform the Company quickly of any unapproved use of his/her account or some other breach of security. The Company will not be liable for any loss that user may incur as a result of someone else using user’s password or account, either with or without user’s knowledge. However, user could be held liable for losses incurred by the Company or another party due to someone else using user’s account or password. User is not allowed use anyone else’s account, without the permission of that account holder.

 

Payment Security

 4inall is only an Intermediary and thus we do not ensure that transactions you conduct online is in a safe and secure. To achieve this, please read the terms of use.

Privacy policy and any other policies or agreements highlighted on each separated third party website whose service the user may decide to avail at a given point in time.

 

Termination

Either 4inall or user may terminate the agreement at any time. Without limiting the foregoing, 4inall will always have the right to immediately terminate user’s account in the event of any conduct by user which 4inall in its sole discretion, considers to be impermissible, or in the event of any breach of this agreement by user.

 

These General Terms and Conditions set out the terms and conditions applying to and governing the usage of the 4inall app - technology which connects passengers with drivers to help them move around cities more efficiently.

In order to use 4inall app you must agree to the terms and conditions that are set out below:

 

1.Privacy Policy

 

1.1 4inall app provides an information society service and does not provide transport services. Transport services are provided by drivers under a contract (with you) for the carriage of passengers. Drivers provide transport services on an independent basis (either in person or via a company) as economic and professional service providers. Disputes arising from consumer rights, legal obligations or from law applicable to the provision of transport services will be resolved between the passengers and drivers. Data regarding the drivers and their transport service is available in the 4inall app and receipts for journeys are sent to the email address listed in passenger's profile.

 

1.2 When using the 4inall app, you can choose whether to pay the driver for the transport service or use 4inall --App Payment. Payments for 4inall Business rides are handled by a separate agreement for Business journeys. Charges will be inclusive of applicable taxes where required by law. Charges may include other applicable fees, tolls, and/or surcharges including a booking fee, municipal tolls, airport surcharges or processing fees for split payments.

1.3 During the installation of 4inall app, passenger's mobile number is linked to the respective 4inall user account and added to our database. If you are no longer using your mobile number, you must notify 4inall within 7 days so we can anonymize your account data. If you do not notify us about any change to your number, your mobile operator might pass the same mobile number to a next person and when using 4inall app, this new person can see your data.

 

2. Promotional Codes

 

2.1 4inall may send you promotional codes on a per promotion basis. Promotional code credit can be applied towards payment on completion of a ride or other features or benefits related to the service and/or a Third Party's service and are subject any additional terms that are established on a per promotional code basis. Expiration dates of promo codes will be reflected in-app once you have applied the promo code to your account.

2.2 If your trip amount exceeds the redeemable credit allocated to your ride, the balance will be automatically deducted from your accounts payment method. Similarly, a promotional code credit only applies on a per ride basis and cannot carry over to a next ride/ trip and therefore will be forfeited. Only one promotional code may be applied per trip.

2.3 4inall reserves the right to cancel any promotional code at any time for any reason. This includes, but is not limited to, if Bolt deems that codes are being used in an unlawful or fraudulent manner, those issued mistakenly, and those which have expired.

 

3. 4inall in-App Payment

 

3.1 You can pay for the transport services with a card, mobile carrier billing and other payment methods, which require prior activation in the 4inall app. By providing 4inall in-App Payment service, 4inall acts as commercial agent for the providers of the transport services. Your obligation to the provider of the transport service will be fulfilled when the payment order is given to transfer funds to 4inall's bank account. You, as a passenger are responsible for ensuring that the payment takes place and ensuring that sufficient funds are available.

3.2 When making payments by 4inall in-App Payment, 4inall receives your payments and forwards money to the driver. 4inall may ask additional data from you to verify payment method.

3.3 When making payments by 4inall in-App Payment for transport services, 4inall is not responsible for possible third-party payment costs (mobile operators, bank fees etc). These service providers may charge you additional fees when processing payments in connection with the 4inall in-App Payment. 4inall is not responsible for any such fees and disclaims all liability in this regard. Your payment method may also be subject to additional terms and conditions imposed by the applicable third-party payment service provider; please review these terms and conditions before using your payment method.

3.4 4inall will be responsible for the functioning of 4inall in-App Payment and provide support in resolving problems. The resolution of disputes related to 4inall in-App Payment also takes place through us. For payment support service please contact: 08518-232510

 

4. Ordering and cancelling transport services

 

4.1 If you order a transport service and the driver has agreed to undertake the work then the transport service is considered to be ordered.

4.2 Once a driver confirms that he/she will complete your journey, you will enter into a separate agreement with the driver for the provision of the journey on such terms and conditions as you agree with the driver. 4inall does not provide journeys and is not a party to your agreement with the relevant driver.

4.3 Cancelling the use of an ordered transport service is considered to be the situation where the driver has replied to your request and you subsequently reject, cancel or refuse the transport service. When a transport service request is cancelled after certain time period you are required to pay a cancellation fee.

4.4 If you cancel a transport service request on multiple successive instances within 24-hour we may temporarily block your account for warning. After multiple such warnings, we may suspend your account for longer period . After that period you could ask to reactivate your account and your application will be reviewed by 4inall.

 

4.5 When driver notifies the passenger about the arrival of the vehicle to its destination and passenger or people for whom the transport was ordered do not arrive at the vehicle within certain time period as specified in the 4inall app, the request will be deemed cancelled. Sometimes driver may decide to cancel your request, please note that 4inall is not responsible for such situations.

4.6 Once the driver arrives and sends you a notification that he/she has arrived the 4inall app may begin charging fare on a waiting time basis according to the rates specified in the 4inall app.

4.7 If you have requested transport services using the 4inall app and cause damage to the driver's vehicle or its furnishing (among else, by blemishing or staining the vehicle or causing the vehicle to stink), the driver will have the right to require you to pay a penalty of Depends on the damage and require compensation for any damages exceeding the penalty. If you do not pay the penalty and/or compensate the damage, 4inall may pursue the claims on behalf of the provider of the transport service.

 

5. License to use 4inall app

 

5.1 As long as you comply with these General Terms and Conditions, we agree to grant you a royalty free, revocable, non-exclusive, right to access and use the 4inall app in accordance with these General Terms and Conditions, the Privacy Notice and the applicable app-store terms. You may not transfer or sub-license this right to use the 4inall app. In the event that your right to use 4inall app is cancelled, the corresponding non-exclusive licence will also be cancelled.

 

6. Liability

 

6.1 As the 4inall app is an information society service (a means of communication) between passengers and drivers, we cannot guarantee or take any responsibility for the quality or the absence of defects in the provision of transport services. As the usage of 4inall app for requesting transport services depends on the behaviour of the drivers, 4inall does not guarantee that you will always have offers available for the provision of the transport services.

6.2 The 4inall app does not offer or broker transport services for passengers. It is also not an transport agency service for finding passengers for transport providers. The 4inall app is used as the means for organising the provision of transport services.

6.3 The consumer's right of refund is not applied to 4inall app orders. Requesting a refund from the transport service does not withdraw you from the agreement in the course of which the provision of the transport service was ordered.

6.4 The 4inall app is provided on an "as is" and "as available" basis. 4inall does not represent warrant or guarantee that access to 4inall app will be uninterrupted or error free. In case of any faults in the software, we will endeavour to correct them as soon as possible, but please keep in mind that the functioning of the app may be restricted due to occasional technical errors and we are not able to guarantee that the app will function at all times, for example a public emergency may result in a service interruption.

6.5 4inall , its representatives, directors and employees are not liable for any loss or damage that you may incur as a result of using 4inall app or relying on, the journey contracted for through the 4inall app, including but not limited to: any direct or indirect property damage or monetary loss; loss of profit; loss of business, contracts, contacts, goodwill, reputation and any loss that may arise from interruption of the business; loss or inaccuracy of data; and any other type of loss or damage.

6.6 The financial liability of 4inall in connection with breach of the contract will be limited to the driver service. You will have the right to claim for damages only if 4inall has deliberately violated the contract. 4inall will not be liable for the actions or inactions of the driver and will not be liable for damages that the driver causes to the passengers.

6.7 You agree to fully indemnify and hold 4inall , their affiliate companies, representatives, employees and directors harmless from any claims or losses (including liabilities, damages, costs and expenses of any nature) that they suffer as a result of your use of the 4inall app (including the journeys you obtain through your use of the 4inall app).

6.8 4inall may immediately end your use of the 4inall app if you breach these General Terms and Conditions or we consider it necessary to protect the integrity of 4inall or the safety of drivers.

 

7. Good practice using the 4inall app

 

7.1 As 4inall is not a provider or broker of the transport services, any issues with defects or quality of the transport services will be resolved in accordance with the rules and regulations of the transport service provider or the relevant public authority.

 

7.2 As 4inall provides:

Taxi Light- 4inall providing the taxi light to 4inall drivers for the purpose of people easily recognize the vehicle ""For Hire"" in addition to the branding.

Mobile Holder- 4inall also providing the mobile holder to the 4inall drivers for the concern of safety and it is dangerous to using a mobile while on drive so, 4inall sincerely recommended to their drivers to use the mobile holder.

7.3 We ask to fill out a feedback form in the 4inall app. This enables us to offer suggestions to the drivers for improving the quality of their service.

7.4 We expect that you use 4inall app in good faith and be respectful of the drivers who offer their services through 4inall app. Bolt retains the right to close your account if you have violated the terms set out in this General Terms and Conditions or if your activities are malicious, i.e. withholding payment for the provision of the transport service, fraud, being disrespectful towards the drivers, etc. In these cases, your 4inall app account may be revoked without prior notice.

7.5 4inall will make every effort to ensure that only drivers, who have integrity and are respectful of their profession and passengers, use the 4inall app. However, we are in no position to guarantee that every provider of transport services, located by the 4inall app, satisfies the aforementioned criteria at all times. If you experience objectionable transport service, please notify the company responsible for the service, a supervisory authority or our customer support.

 

8. Amendments to the General Terms and Conditions

 

8.1 If any substantial amendments are made to the General Terms and Conditions, then you will be notified by e-mail or 4inall app notifications. If you continue using 4inall app, you will be deemed to accept the amendments.

 

9. Final Provisions

 

The General Terms and Conditions will be governed by, and construed and enforced in accordance with the laws of Indian Government the respective dispute resulting from General Terms or Agreement could not be settled by the negotiations, then the dispute will be finally solved in The presence of judiciary If any provision of the General Terms is held to be unenforceable, the parties will substitute for the affected provision an enforceable provision that approximates the intent and economic effect of the affected provision. Auto Rickshaw Driver Terms and Conditions

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the provisions pertaining to electronic records in various statues as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. By clicking on the “I ACCEPT” button, You are consenting to be bound by these Driver T&C for using Portal. PLEASE ENSURE THAT YOU READ AND UNDERSTAND ALL THESEDRIVER T&C BEFORE YOU USE THE SERVICE OF THE PORTAL, AS YOU SHALL BE BOUND BYALL THE DRIVER T&C CONTAINED HEREIN upon clicking on the “I ACCEPT” button. If You do not accept any of the Driver T&C, then please do not use the Portal or avail any of the services being provided  therein. YOUR AGREEMENT TO THE DRIVER T&C SHALL OPERATE AS A BINDING AGREEMENT BETWEEN YOU AND  “4inall” IN RESPECT OF THE SERVICES OF THE PORTAL.

Your engagement with 4inall to use the services of the Portal are subject to your acceptance of these Driver T&C. 4inall reserves the right, at its sole discretion, to change, modify, add or remove these Driver T&C, in part or in whole, at any time, without prior notice to You. It is Your responsibility and duty to check the Driver T&C periodically for changes. Your continued use of the Portal following the posting of changes will mean that You accept and agree to the changes. As long as You comply with these Driver T&C, 4inall grants You a personal, non-exclusive, non-transferable, limited privilege to enter and use the service on the Portal.

 

Zero Tolerance Policy

Driver will strictly follow this ZERO TOLERANCE policy which shall be subject to change and any changes shall be intimated to the Driver from time to time via SMS or e-mail.

 

Asking for tips:

Driver shall not Proactively ask for ‘tips’ from the Customer. Driver shall not hassle the Customer for change.

As informed by 4inall from time to time

 

Wasting Customer’s Time:

Driver shall not stop the Vehicle for filling fuel in between the journey. Driver shall not make any Personal stops during the journey.

 

Personal hygiene:

Driver shall wear neat  driver uniform & badge at all times during duty hour. Driver shall maintain personal hygiene.

Customer Service:

Driver shall greet Customers both at pick up and drop.

Driver shall manage the luggage (both at pick-up and drop point).

 

Vehicle Cleanliness:

Driver shall keep the Vehicle clean.

 

Disturbing Customer:

Driver shall not play loud music (above mid-level of the stereo) or music through any kind of earphone device. Driver shall not unnecessarily blow horn. Driver shall not proactively engage into a personal conversation with the Customer and shall not resort to any kind of unpleasant behaviour with Customers.

 

No Smoking/Tobacco/PanMasala/Food Item:

Driver shall not smoke inside the Vehicle. Driver shall not chew any masala or chewing gum or any other food item while a ride is in progress The Driver shall ensure that he has adequate change with him so that at all times he is in the position to return the  balance amount to the Customer.

The Driver should not make any fake calls or give any missed calls to the Customer’s contact number. The Driver should only give a call to the Customer informing the Customer about the arrival of the Vehicle at the destination. Driver shall not make unwarranted use of the Customer contact details after the customer has been dropped at the destination, The Drivers shall be well versed with the routes. The Driver shall not take any long route when there is another short route known to him for reaching the destination. The Drivers are not expected to halt at several places during the journey due to lack of knowledge of the routes.

 

Delay In Pick – Up:

Driver should reach the pickup point (before pick-up time ). Driver must intimate the Customer that he has reached at the pick - up location Driver should keep his mobile ‘ON’ while he is logged into the 4inall app and he should receive every call of the Customer. Driver should not make any deliberate attempt to park the Vehicle in ‘no network’ area while the Customer is away for his/her personal work.

Vehicle Branding:

4inall Sticker, if any, on the Vehicle should not be removed till the Vehicle is active on the Platform.

Rude Behavior with Female Customer:

Driver shall not under any circumstance argue with the Customer/use abusive words / raise his voice tone while talking to the Customer. Driver should follow the instructions given by Customer as well as by 4inall administration.

 

Mobile Phone Usage:

Driver shall not use mobile phones (unless for emergency purposes) while driving. This includes but not limited to SMS, video calls, voice, MMS and downloading. However, this shall not apply in case of calls from 4inall representatives and the Customer.

 

Reporting To 4inall :

Driver shall not lie about Vehicle’s position to the 4inall representative. Driver shall not report meter readings incorrectly.

 

Rash Driving:

Driver shall not exceed the speed limit of:

 

Driver shall follow the said prescribed lower speed limits. Driver should not apply sudden breaks and should not take sharp turns that may cause inconvenience to the Customer.

 

Driving License (DL) & Other RTO Documents:

While on duty hours with 4inall it is mandatory to keep DL and all relevant RTO impacting papers ( Insurance, RC, etc.).

• While performing the Services, Driver should not sleep in the Vehicle.

Driver shall not reject the booking on his own at the time of allotment under any circumstances (unless permitted by 4inall). Driver shall not reject a booking or a Customer once he has accepted the duty and logged in and shall not switch off his mobile under any circumstances.

 

Missing luggage:

Driver should hand over the luggage or bags to the office, if the Customer has mistakenly left any luggage in his vehicle or the Driver should call to the Customer and inform him that he has forgotten his belonging in the cabs.

 

Traffic Rules:

Driver shall obey all traffic rules including traffic signals. Driver shall keep all statutory documents (insurance documents, vehicle registration book/card, etc.) at all times.

 

Driver lying or completing service in bad-faith:

Driver should follow the best and shortest possible route to reach the destination. Driver should not misrepresent or misguide the routes or duty slips to increase the fare. Driver shall not consume/intake or be under the influence of alcohol or narcotic substances while logged into the 4inall app.

 

Abusive or discriminatory Driver:

Driver should not do anything like abusing the Customer, talking to Customer or any such behaviour which shall make the customer feel uncomfortable during journey. Driver should not discriminate against Customer for any reason, including on the basis of sex, race, caste, creed, religion, disability or nationality.

 

Rude behavior/Customer:

Inconvenience:

Driver should not ask the Customer to get down from his vehicle in the middle of the journey even if any misunderstanding or verbal fights happen between the Customer and the Driver. If his Vehicle gets breakdown he himself should call the 4inall office and make arrangement for another vehicle at any cost for the Customer and drop the Customer to the drop location.

 

Extra Ordinary Circumstances:

Any instance of Driver’s behavior that like abusing the Customer, talking to Customer or any such behaviour which shall make the customer feel uncomfortable during journey. Driver should not discriminate against Customer for any reason, including on the basis of sex, race, caste, creed, religion, disability or nationality.

 

Extra Ordinary Circumstances:

Any instance of Driver’s behavior that directly or indirectly impacts the Company’s “Brand Image”.

Maximum Weight Never load the vehicle above the manufacturer ’s maximum specified weight.

Medically Fit

Never drive the vehicle if the driver is not fit since medical conditions may impact on driving.

Unauthorized Goods or Persons

Not carry any unauthorized goods or persons till the completion of the Ride.

Commercial Terms Segment

 

In addition to the definitions, above:'

“Operator Minimum Bill” shall mean the minimum amount, per completed ride, payable to the Driver, as per minimum fare prescribed;

“Cost per km” shall mean an additional amount, over and above the Operator Minimum Bill, that may be paid to the Driver at 4inall’s sole discretion;

 “Wait Time Cost” shall mean an additional amount, over and above the Operator Minimum Bill, that may be paid to the Driver at 4inall’s sole discretion;

“Trip Time Cost” shall mean an additional amount, over and above the Operator Minimum Bill, that may be paid to the Driver at 4inall’s sole discretion;

“Convenience Fee”/“Access Fee” shall mean the fee payable by the Customer to 4inall for the Service i.e., for availing the technology services offered by 4inall, door to door service, customer support and cashless payment options. Convenience Fee shall be chargeable on every booking made through the Site. The Convenience Fee shall be exclusive of all applicable taxes on the Convenience Fee, if any;

“Operator Commission Fee” shall mean the pre-determined fee payable by the Driver to 4inall for facilitation of business i.e. obtaining bookings, on his behalf by 4inall.

  • Driver should ensure that, registration details providing are completely valid and accurate. 4inall has no liability for false, incomplete and old registration data by him.

  • Driver should maintain confidentiality about his credentials and will be liable and responsible of all his activities which is performed through his account (4inall driver account). 4inall has no liability for any loss that you may occur due to someone else using your passwords or account, either with or without your knowledge.

  • Driver should not transfer, sell or assign his 4inall driver account to others.

  • Driver should maintain discipline at workplace and possess good attitude.

  • Driver should carry all the required documents all the time. In case of failure, you may get fined or seized by respective department of government. 4inall is nowhere responsible for that.

  • Driver uniform is mandatory when they are at work.

  • Driver should follow all traffic rules and regulations.

  • Driver should not do drink and drive.

  • Driver should report back to 4inall management in case of any problem caused by the passenger immediately.

  • In case of any physical damage to the vehicles and human loss or human health issues due to accidents, 4inall is not responsible for that loss.

  • In case of any driver or user health issues during on ride, 4inall is not responsible for that.

  • Driver should not force passengers for extra payment or tip.

  • Driver should follow 4inall listed seating capacity (1Driver+3Passengers).

  • Driver should maintain social distancing and always wear mask and carry sanitizer.

  • Driver should carry out a frequent water wash of the vehicle.

  • Driver should make sure the vehicle is in good condition.

  • Driver should not turn off his location or switch off his mobile phone when he is in ride.

  • Drive should agree and aware for the ride pricing structure of normal and peak times which is stated by 4inall.

  • 4inall has a right to terminate the account within no time, if there is any discrepancy/inaccurate in registration data or result of negative attitude reported feedback by users.

  • Driver should not misuse user’s information. In case of failure to keep them confidential, driver may fall under punishable offense which will be handled by respective department of government. 4inall is nowhere responsible for that.

  • 4inall will not ask any bank/card OTP through calls and in office as well. Do not share any debit card details over the phone.

  • 4inall is assured to process the ever driver payouts at end of the day and the same will be credited back to the driver bank accounts.

  • 4inall has made this information transparent to drivers and the same has been accepted by drivers.
